Valley Metro – Alt Mode User of the Game Contest
Official Rules and Regulations
Please read these Official Rules and Regulations (the “Rules”) carefully before entering the Alt Mode User of the Game Contest (the “Contest”) conducted by Valley Metro, a regional public transportation authority authorized under A.R.S. § 48-101 et seq. (“Valley Metro”). By submitting an entry, you (the “entrant” or “participant”) agree to be bound by these Rules and acknowledge that you meet all of the Contest’s eligibility requirements.
NO PURCHASE IS NECESSARY TO ENTER OR WIN. THE CONTEST IS OPEN ONLY TO RESIDENTS THAT LIVE OR WORK IN MARICOPA COUNTY, ARIZONA.
1. Eligibility.
a. To be eligible to participate in a drawing, you must (1) be a resident of Maricopa County, Arizona, (2) be eighteen (18) years of age or older, and (3) submit an entry during the applicable entry period for that drawing. (See Section 2 below.) Employees of Valley Metro/RPTA and R&R Partners, their affiliates, representatives, advertising and promotion agencies and their employees and family/household members are not eligible to participate or win prizes. All applicable laws apply.
b. Winner(s) must sign and return a notarized Affidavit of Eligibility and Liability Release so that it is received by Valley Metro ten (10) days from the date printed on the written notification, or else an alternative winner will be selected.
c. Failure to comply with these Rules, tampering with the legitimate operation of the Contest, or otherwise engaging in any conduct that Valley Metro determines, in its sole discretion, is harmful to Valley Metro, will result in immediate disqualification, and, where applicable, the selection of an alternative winner.
2. How to Enter.
a. You may enter the contest for using an alternative mode of transportation for each of the 2006-07 ASU regular “sports seasons:” Football, Basketball and Baseball. Enter by submitting an entry on-line or by phone at 602-262-7433. Limit one entry per person for each ASU “sports season.” Anyone entering more than once for a “sports season” will not be eligible for the drawing. Winning entries will be randomly selected by Valley Metro and/or its assigned agents, whose judging decisions are final and binding on all matters related to the Contest. Drawing dates will vary depending on the specific date of the home game for each set of winning tickets. The winner will be notified by phone, email or certified mail within ten (10) days of the drawing date. Return of the prize notification as undeliverable will result in disqualification and selection of an alternate winner.
b. Participants who enter the Alt Mode User of the Game Contest by calling Valley Metro at 602-262-RIDE (602-262-7433); must do so during Valley Metro’s normal business hours (Monday through Friday, 8 a.m. to 5 p.m. MST) for the applicable week of entry.
c. Entries will not carry over from one “sports season” to the next; participants must re-enter the Alt Mode User of the Game Contest for each “sports season” they use an alternative mode of transportation. The participant may enter for using an alternative mode of transportation (carpool, vanpool, bus, bike, walk, telework, compressed work week). All entries are limited to individual persons. Multiple entries by the same person using different contact information, or mechanically reproduced entries or facsimiles, are not permitted and will result in disqualification of all entries. Entries where the identity of the winner is disputed or unclear (as determined by Valley Metro in its sole discretion) will be voided.
d. Neither Valley Metro, R&R Partners nor their parent companies, subsidiaries, affiliates, or agents are responsible for any (i) incorrect or inaccurate transcriptions of entry information, (ii) telephone, electronic, Internet, software, hardware, equipment or other computer or communications related malfunctions or errors, (iii) late, lost, delayed, illegible or misdirected entries or data transmissions or (iv) any damage to a participant’s system or equipment resulting from participation in the Contest or by downloading any information from the Valley Metro website.
e. Valley Metro, in its sole discretion, reserves the right to modify these Rules or to cancel or suspend the Contest or any portion of the Contest at any time for any reason. Valley Metro may disqualify any individual who damages or tampers with the Valley Metro website or any aspect of the Contest.
3. Prizes
a. The prizes to be awarded in the Contest (collectively, the
“Prizes”) are: 2 tickets to each ASU home game and a parking pass (Men's
games only) during the 2006-07 NCAA College Men's and Women's Basketball regular season.
b. All Prizes are nontransferable and nonrefundable, and substitutions or cash exchanges are not permitted, except that Valley Metro reserves the right to substitute (in its sole discretion) a prize of equal or greater value for any Prize. All Prizes must be used by the date or dates indicated on the Prize or will be forfeited. Transportation, meals, gratuities, hotel incidentals and any other expenses not specified are the winner’s responsibility. Use of Prizes is subject to availability, black out dates and other applicable restrictions. Winners will be issued a 1099 tax form for the approximate retail value (ARV) of the prize. The odds of winning will be dependent on the number of eligible entries that are received by Valley Metro.
c. ALL PRIZES ARE AWARDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
d. NEITHER VALLEY METRO, R&R PARTNERS NOR ANY OF THEIR PARENT COMPANIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, OR AGENTS SHALL BE LIABLE FOR ANY COSTS OR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE CONTEST, OR FOR ANY CLAIMS, DAMAGES, OR INJURIES ASSOCIATED WITH ACCEPTANCE OR USE OF THE PRIZE AND/OR ANY TRIP-RELATED ACTIVITIES.
e. ALL WINNERS ACCEPT ANY AND ALL RISKS ASSOCIATED WITH THE ACCEPTANCE OF ANY PRIZE. IF A WINNER ELECTS NOT TO ACCEPT SUCH RISKS, THEN THE WINNER MAY REFUSE THE PRIZE.
4. Use of Winner’s Name and Likeness; Posting of Winners
a. Except where otherwise prohibited, entry into the Contest and acceptance of a Prize constitutes permission for Valley Metro and/or R&R Partners, as well as their respective promotional agents, to use the winner’s name, likeness and prize information for advertising or promotional purposes related to this Contest; as a condition to being awarded any Prize, all winners will be required to execute a consent to use their name, likeness and prize information for such purposes without further permission or compensation.
b. The names of all winners will be posted at www.valleymetro.org after eligibility is confirmed. To obtain a name of a winner, you also may send a letter request along with a self addressed, stamped envelope to 302 N. 1st Avenue, Suite 700, Phoenix, Arizona 85003.
5. Other Provisions
a. The Contest is governed by the laws of the state of Arizona and the United States. Any action brought by any participant or any party to enforce, or otherwise related to, these Rules shall be brought in the state and federal courts located in Maricopa County, Arizona; by participating, you expressly acknowledge and consent to the jurisdiction of such courts. In the event any provision of these Rules is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of any of the remaining provisions shall not in any way be affected or impaired. Valley Metro retains all copyright and other intellectual property rights in the Contest and accompanying materials.
